Before signing up for a Dinger Account, please notify any Dinger Services (as defined below statements) and you are agreeing and accepting all these Terms and Conditions (defining "Terms of Services"). The terms used in "Terms and Conditions" affiliate (collectively "we", "us,'' "our" and "Dinger") respect your privacy. The main objective of this privacy policy mainly points to how we collect and maintain Personal Data, how we process Personal Data, how we disclose Personal Data, with whom we share it, your rights and choices and how you can investigate and contact us for more privacy practices. The services offered by Dinger under the Terms of Services may depend on types of accounts: Store Owner or Customer which are described below. You must read, agree and accept with Terms of Services and conditions before you sign up Dinger account. Dinger has the right to update or modify terms and conditions by posting on the Dinger website and related social media. We advise you to check our terms and conditions for any updates at any time. If you are not accepting or agreeing with the Terms and Conditions, you cannot able to use Dinger Services. We are providing two languages: English and Myanmar for your convenience in viewing the Dinger website. Please read documents and statements that are referred to in these Terms and Conditions. You are agreeing with these Terms and Conditions if you start using Dinger Account and Dinger Services. Please make sure to check back for any updates.

Overview

Dinger is the product of Bards Ltd. Dinger is the resettlement solution to equip online shopping with more efficient settlements than their current solutions. Our mission includes providing an improved shopping experience for both store owners and their customers. You may be one of our Dinger website visitors will use as "You", "Your" and "Dinger user". The terms and conditions may depend on the type of Dinger account.


Account Types

1. Store Owner Account

1.1. Account Terms of “Store Owner Account”
  • To access and use of Dinger Services, you need to register a Dinger account by providing certain personal information about you, which is indicated as required.
  • The Dinger Account user must be 18 years old or at least in the age of majority where you reside to open an Account.
  • Dinger Services are only providing for purposes of business activity and not for any personal purpose.
  • Dinger will use the email address or mobile number that you have provided in registering an account for purposes of updating by you as the primary method to communicate with you.
  • The Dinger account user needs to keep secure email and password. Dinger will not be accountable for any loss or damage from user failure to maintain the security of Account and Password.
  • You are obligated for all activities, (data uploading such as photos, videos, audio, contents, data storage, data collection, data distribution, data generated in your Account).
  • Your application can be rejected or block your future access to the Site due to our sole discretion if we determine that you have violated Terms of Use or other agreements.
1.2. Account Activation of “Store Owner Account”
  • The person who registered the Dinger Account will be the contracting party “Store Owner” to accept Dinger Terms of Services. The Store Owner will be the person who gains authorization to access our connection with service.
  • If you are logging in the Dinger Account for behalf of your employer (Store Owner), you must use your employer-issued email address. You have to state, represent and warrant for binding the authorization with your employer to our Terms of Services via mobile or email ([email protected]).
  • One Store Owner can only associate with one Dinger Store. “Store” represents “online stores” or “other physical retail locations” which are associated with the Dinger Account.
1.3. How we collect Personal Data “Store Owner Account”

Dinger offers certain features or services through the Site and you have to open Dinger “Store Owner” Account. In registering Dinger Account, we collect Personal Data about you. Personal Data is information that relates to an individual’s identity. Personal Data that you entered in registering a Dinger account will directly reach to our Site.

  • In registering a Dinger Account, we collect your contact details (such as your full name, contact number, email address, etc.) and account log-in credentials.
  • If you want to contact our Dinger team, we collect fill-in form (including your full name, work email) and anything you want to tell or suggest about Dinger.
  • If you contact by email, we collect your email address, your name, subject of the email and the information that you provide in the body of the email or responses.
  • If you contact by phone, we collect your full name, phone number and other information as needed. If you are a Dinger “Store Owner” Account user, we collect additional information to verify the identification of Dinger users.
  • When you use one of the Dinger features “Remember Me”, we collect your email address and payment card number or account number for the mobile wallet.
  • As part of a business relationship with Dinger, we also receive your personal and financial information (such as date of birth, tax number and government identifiers associated with you and your business).
  • When we manipulate faults controlling and inspecting activities, we may also receive Personal Data about you from openly available sources (such as name, phone, email address) to approve the identification and prevent unnecessary frauds.

Other methods are available to apply: (i) by social media or online platforms, (ii) through phone, participating programs or other communication platforms, (iii) by giving your contact details or business cards at events. Cookies and Other Technologies are used to handle our system more efficient and effective. These systems and technologies automatically record data of your use of Services.   • Data from Device and Browser: Data such as IP addresses, internet browser type, device model, device name, device manufacturer, operating system and the language of the Sites which you are visiting.
  • Data Usage: Data such as the time visited on the sites, duration time spent on the sites, links entered, pages visited or viewed and the pages that referred you to our Sites.
1.4. How we process Personal Data “Store Owner Account”

We use Personal Data to enable business relationships with you and customers in compliance with financial regulations and other legislations. We also use Personal Data in Payment transactions and other payment-related services to be accomplished.

  • Marketing and other communications: We may alert and notify our products and services to your email address. We may also send invitations to participate in our events to get more communications for marketing purposes. We may also gather Personal Information from people who attend trade shows and events. We may use this information for more follow-up sessions with you concerning an event and shows and we may inform about our products and services. You can include our marketing campaigns with your permission.
  • Interest-based Advertising: Both we and limited third parties assemble online activities that you entered overtime to our Sites and Services. When you cross to different sites, we will accommodate advertising messages about our products and services which are tailored to your interests (called interest-based advertising). As we use cookies and other technology on your device’s browser, it can automatically identify and store the use of pixel tags. If necessary by applicable law, we will gain consent prior to your information of processes for the objective of interest-based advertising. Our ads will display on other browsers and websites or mobile apps as we linked in advertising networks. 1.5. How we disclose Personal Data of “Store Owner Account”

Dinger never intentionally or unintentionally sells or rents Personal Data to other unaffiliated third parties. We only use and share your Data between trusted entities which are stated below.

  • Dinger Server: We manage and share Personal Data in Dinger Servers to provide Dinger Products and Services.
  • Related Service Providers: Personal Data will be disclosed to related service providers such as identity verification services, web servers, related infrastructure fields, email servers, and auditing services. Personal Data is used as identification to access their services. These service providers also comply with laws, regulations and other legislation. We authorize that these service providers will use Personal Data to perform and facilitate their services with us. Such service providers have contractual commitment to protect the confidentiality and security of Personal Data they make processes on our behalf. 
  • Business Partners: We have to share and disclose Personal Data to third party business partners especially to Financial Institutions and Non-Financial Institutions (Banks, Mobile wallets such as Wave, TrueMoney). This disclosure is for payment transactions.
  • Store Owners and other third party customers: We share Personal Data to you to maintain Dinger “Store Owner” account and to utilize our services. Personal Data will also be shared with other third parties “customers” who are associated with your business to access and gain Dinger services with Customers. This disclosure will be processed through our Dinger Platform.
  • Corporate transactions: Your Personal Data and every transaction you make with your customers will be recorded on both Dinger Servers and Databases. We may also share Personal Data with third parties to facilitate the accomplishments of transactions.
  • Compliance and harm prevention: If necessary, we may also share Personal Data to related fields of government to comply with applicable laws in order (i) to protect the privacy, confidentiality, and property of Dinger, you and your customers; (ii) to respond to the regulatory agencies, public and government authorities which may be located outside of your country of residence.
  • Restrictions to “Store Owner Account”

We regulate certain requirements in accessing a Dinger account. We access the quality of the particular online store owner in the following facts.

  • Dinger “Store Owner Account” user has to accept the terms and conditions before anything else.
  • Only pages with 10,000 followers or more will be eligible to use Dinger.
  • A page shouldn’t have any bad history in the last (Three) months to use Dinger.
  • The online store owner should have a complete and reliable delivery process to fulfill the customers’ requirements. Dinger has a right to discuss and monitor on delivery process.
  • Dinger has a right to check the suppliers’ network of particular online shopping to ensure that your information is secure with us.
  • Online shopping used for selling any illegal items, including drugs, will not be eligible to use Dinger.
  • If we suspect the act of AML (Anti Money Laundry) or Financial Act of Terrorism on the online shopping, we will suspend the service and investigate further.

2. Customer Account

2.1. Account Terms of “Customer Account”
  • Your account will automatically be registered via Facebook. 
  • Dinger Services are only providing for purposes of business activity and not for any personal purpose. Dinger user has to confirm and agree for any Services provided by Dinger.
  • Your account can be rejected or block your future access to the Site due to our sole discretion if we determine that you have violated Terms of Use or other agreements.
2.2. Account Activation of “Customer Account”

The person who registered the Dinger Account will be “Customer” to use the Dinger Terms of Services. You can get full authorization to access our connection with service.

2.3. How we collect Personal Data of “Customer Account”

Dinger offers certain features or services through the Site may require to open Dinger “Customer” Account. In registering Dinger Account, we collect Personal Data about you. Personal Data is information that relates to an individual’s identity. Personal Data that you entered in registering a Dinger account will directly reach to our Site.

  • We automatically collect your contact details from Facebook (such as your full name, contact number, email address, etc.) and account log-in credentials.
  • If you want to contact our Dinger team, we collect fill-in form (including your full name, email address, etc.) and anything you want to tell or suggest about Dinger.
  • If you contact by email, we collect your email address, your name, subject of the email and the information that you provide in the body of the email or responses.
  • If you contact by phone, we collect your full name, phone number and other information as needed. If you are a Dinger “Customer” Account user, we collect additional information to verify the identification of Dinger users.
  • When you use one of the Dinger features “Remember Me”, we collect your email address and payment card number.
  • When you make the payment or manipulate transactions through Dinger “Store Owner” website or application, we also collect and receive transaction information directly from you or your Dinger “Store Owner” or other third parties. The information includes data about personal data (name, phone number, address), debit card number or bank account/E-wallet information, purchasing total amount, payment type, total quantity and purchasing date. Payment type may depend on what you choose to use from listed available payment types that are offered to you. After you complete the transaction, we receive transaction history which includes your full name, Transaction reference number, transfer date, the total amount to authenticate you.
  • When we manipulate bugs monitoring and inspecting activities, we may also receive Personal Data about you from publicly available sources (such as name, phone, email address) to confirm the identification and prevent unnecessary frauds.
  • Cookies and Other technologies are used to manipulate our system more efficiently and effectively. These systems and technologies automatically record data of your use of Services.   • Corporate transactions: Your Personal Data and every transaction you make with your Store Owner will be recorded on both Dinger Servers and Databases, and also incorporate manual transaction books. We may also share Personal Data with third parties to facilitate the accomplishments of transactions.
  • Compliance and harm prevention: If necessary, we may also share Personal Data to related fields of government to comply with applicable laws in order (i) to protect the privacy, confidentiality, and property of Dinger, you and your store owners; (ii) to respond to the regulatory agencies, public and government authorities which may be located outside of your country of residence.
  • Restrictions to “Customers”

We regulate some requirements in accessing a Dinger account in the following facts.

  • Dinger user has to accept the terms and conditions before anything else.
  • Buying any illegal items, including drugs, will not be eligible to use Dinger.
  • If we suspect the act of using a Dinger Account against Anti-Money Laundering laws and Financial Act of Terroism, we will suspend the service and investigate further.

Security and Retention

Our Dinger uses a level of security with reasonable efforts to all possible risks associated with the process of Personal Data. Our Dinger team protects your Personal Data with technical, organizational and other administrative measurements. Only our Dinger team and another limited number of third parties can access your Data in providing our services to perform.

Your Personal Data of Dinger account will be retained as long as you are partnering with us and accepting our services. Even if you want to close your account, we have to retain them to comply with financial and other regulatory obligations. We retain your data in corporate transactions and the Dinger server for any limitation periods to record retention obligations that are imposed by applicable law. Unfortunately, we cannot guarantee our data storage and transmission system to be 100% safe and secure. If you feel something about the security of your account, please let us know and contact us immediately.


Fraud

Any other person or an organization or an agency misusing the Dinger payment model (payment link).

From the Buyer’s side

Denial of receiving the product: if you want to deny of receiving the product, you can complain that products or part of the products that you purchased is completely missing or parts of the product are missing. As a solution, firstly you can file this case to the Dinger team to investigate and refund process for the product. Secondly, the Dinger team will check with the store owner that it is a valid request or not. It may take at most 21 days to be resolved.

Fake return

You file about the return but you don’t return the products or parts of the product. Dinger will control this case by defining the return process. We will have our official partner for returning the product. We will investigate together with our partner. That could take up to 21 days to resolve.

Demand to refund after the purchase

You purchased and completed the transaction but you demand to refund. As a clarification, Dinger will get consent from the user that nothing can be refunded after the purchase unless fake items or fake description. If the product is in those stages, you can file a case to the Dinger team.

From the Seller’s side, Unmatch product

Products that are not matched with their description (showcase on the Dinger interface). Store Owners sell the product with description but fail to deliver the exact detail description of those products or fake products. End customer needs to file a case to be investigated by the Dinger team. It will take up to 21 days. If the store owner is doing the fraud, we will terminate the contract.

Misusing Dinger Brand

Store owners imitate the payment method of Dinger purposely to take the data of customers’ payment information or any other information. As a solution, Users have to accept the terms and conditions of the Dinger team. In that, we will have a statement that the user has to check that the URL is correct or not. If it is not a correct URL, the consequences will be responsible by the user. They can come and check that URL on the Dinger website. Acting as Dinger: Store owners claim that they are using Dinger but they are not (but registered in Dinger) and charging extra transaction charges from customers. In user terms and conditions, we will add the statement that if the user didn’t use the link from Dinger, Dinger is not responsible for any consequences. From the internal side, Staff: Data breach or leaked by internal staff. A dedicated user role with limited functions. Employees cannot see the data after transferring money. The database is only accessible by certain people in the organization. Money Laundering: Different employees on verifying and transferring transactions. If there is, we will terminate the employment contract. General prevention protocol: As for the internal, Dinger will have strict regulations about data policy and payment monitoring will only be accessed by staff who are monitored by our management team 24hr.


Use by Minors

The Site and Services are not allowed to individuals who are under the age of 13. We would never knowingly accept Personal Data from children or individuals who are not legally able to use our Site and Services. Please contact us if we are mistakenly accepting Personal Data from a child who is under the age of 13, we will promptly delete it.


General Conditions

You must read and agree with all these terms and conditions before you become a Dinger user.

  • Only Dinger users can get technical support compliance with Dinger Services.
  • Dinger is providing the Terms of Services in respect of the laws of the Republic of the Union of Myanmar.
  • Dinger reserves the right at any time, without notice: (i) to modify or update the Site, or any portion of the Site, and any applicable policies or terms; (ii) to modify or terminate accession to the Site, or any portion of the Site thereof; (iii) to interrupt any part of the operation of the Site as necessary to perform routine or non-routine maintenance or to make other changes. Such modifications are effective to this agreement by the last update date. The modifications are properly constituted with your continued use of the Services, your agreement and acceptance thereof. If you do not accept with adjustment of Terms of Services, please do not continue with the use of services.
  • Dinger strongly restricts using our Services for any illegal or unauthorized purpose or any violation with the applicable Myanmar laws of perspective. Dinger users have to comply with all rules and regulations in using Dinger Services and you should perform all obligations under the Terms of Services by Dinger. Dinger may monitor your use of services to ensure that you are following usage rules.
  • You are inhibited to copy, duplicate, trade, sell, resell, reproduce part of the Services, access of Services without permission granted by Dinger.
  • You shall not misuse of domain names which associate with Dinger or Dinger trademarks or other subjected variations.
  • Questions, inquiries or other investigation can be sent to Contact Us.
  • You acknowledge the use of Services, including your data and information are stored and kept by Dinger. Please assume that your data excluding your payment  information may be transferred to relevant Dinger networks and unencrypted. Dinger especially protects and encrypts bank account information/ e-wallet information during transfer over the networks.
  • Short message service (SMS) messaging system is allowed to notify your customers associated with order confirmation notifications thereof. These message services should be followed and complied with the Terms of Services.
  • You can view the Terms and Conditions of Dinger in two languages: English and Burmese to some extent of misunderstanding between these English terms of Services.
  • All these stated terms and conditions may be combined with Dinger's legal representatives. Dinger has full authorization of these Terms of Services without notifying you. Dinger users shall not transfer or no right to misuse Terms of Services of Dinger by deliberately withholding the discretion of Dinger.

Jurisdiction-Specific Provisions

Residents of the Republic of the Union of Myanmar (Burma), in Southeast Asia. The entity responsible for collecting and processing of Personal Data for residents of the Republic of the Union of Myanmar (Burma), Bards Company Limited, a company incorporated in Myanmar and with an office at Chinatown Hotel, Lathar Township. About your rights, you can contact the Data Protection Officer through email.

Tax

The customers and store owners will be solely responsible for all Taxes (if any) on any amounts that the customers and store owners receive as per the customers' and store owners’ normal tax obligations in the course of its own business.

Force Majeure

In case of force majeure such as natural disasters, acts of God, riots, war, act of civil or military authorities, the change of law or regulation and any other events that are beyond the abilities of both parties to control or predict, causing adverse effects or negatively influencing the said agreement implementation, the victimized party shall make a written report about the actual causes and impacts of the event along with the evident to the other party within 7 days for both parties to hold a discussion and seek measures for appropriate resolution.

Renegotiation

In the event any situations or condition arises due to the circumstances not envisaged in the agreement and warrants amendment to the agreement, the parties shall renegotiate and make necessary amendments.
